The company Lesaffre International, a limited liability company, registered under SIRET 434 011 458 00024 with the RCS of Lille Métropole, whose registered office is located at 137 rue Gabriel Péri 59700 MARCQ-EN-BAROEUL (hereinafter referred to as “Lesaffre International“) publishes the website accessible at the URL www.fermentis.com (hereinafter “the Site“) in order to provide general information about the activities of the Lesaffre Group.
For the purposes of these General Terms of Use (hereinafter the “GTU“), the Lesaffre Group (hereinafter “Lesaffre Group“) refers to the whole composed of the company Lesaffre et Compagnie, a public limited company with a board of directors, registered under SIRET 31605567200018 with the RCS of Paris, whose registered office is located at 41 rue Etienne Marcel, 75001 PARIS, as well as its subsidiaries, regardless of their place of establishment. In terms of participation, control of companies and dominant influence, all companies meeting the criteria mentioned in articles L233-1 to L233-3 and L233-16 of the French Commercial Code are defined under this article.
The purpose of these terms is to define the conditions under which any person, regardless of the access device (computer, tablet, etc.), type of connection (private connection, public WiFi, etc.) and place of connection may access and use the Site (hereinafter referred to as “Users” or individually the “User“).
ARTICLE 1 – DESCRIPTION OF THE SITE
1.1 The Site provides information about the Lesaffre Group, its activities, its missions and businesses, as well as its news.
1.2 The Site allows the User to:
- Access the websites of other subsidiaries and business units of the Lesaffre Group;
- Contact Lesaffre International via contact forms;
- Consult the Lesaffre Group’s job offers and apply online;
- Create a job alert.
1.3 Lesaffre International may evolve the functionalities of the Site, without this giving rise to any compensation for the User. Thus, Users are expressly informed that the provision of all or part of the functionalities is at the discretion of Lesaffre International.
ARTICLE 2 – TECHNICAL ACCESS AND USE CONDITIONS OF THE SITE
2.1 The Site is compatible with standard market browsers. It is the User’s responsibility to ensure that they are using a browser that is up to date at the time of consulting the Site. Otherwise, they may encounter difficulties accessing or using the Site.
2.2 All hardware and/or software necessary to access and/or use the Site are exclusively the responsibility of the User, who is solely responsible for the proper functioning of their equipment as well as their Internet access. It is the User’s responsibility to ensure that they have an Internet connection that allows them to use the Site. 2.4 The Site is accessible except for interruptions for maintenance reasons and/or force majeure and/or in the event of an occurrence beyond the control of Lesaffre International. The liability of Lesaffre International cannot be incurred in the absence of fault, in the event of any unavailability of the Site, for whatever reason, and will make its best efforts to restore the service.
ARTICLE 3 – ACCEPTANCE AND MODIFICATION OF THE GTU
3.1 Access to and use of the Site are subject to compliance with these GTU. Thus, before consulting the Site, any User must read the GTU, which are accessible from the Site’s home page and from each of its pages.
3.2 The GTU may be modified by Lesaffre International to take into account in particular the evolution of the Site’s functionalities as well as applicable regulations. Any new version of the GTU will be made available to Users on the Site. The User must therefore consult the GTU regularly.
ARTICLE 4 – OBLIGATIONS – LIABILITY
4.1 The User undertakes to use the Site in accordance with these GTU. By accessing and using the Site, the User in particular refrains from:
- any use of the Site contrary to applicable laws and regulations or violating the rights of third parties;
- any action that may cause harm to Lesaffre International, to one or more entities of the Lesaffre Group or to another User;
- harming, hindering, distorting the proper functioning of the Site;
- probing, scanning, scraping, technically analyzing the Site;
- testing the vulnerability, performance, functionalities of the Site for any reason other than those necessary for its use;
- circumventing the measures implemented by Lesaffre International to ensure the security of the Site.
4.2 The User expressly acknowledges that if they do not comply with these General Terms of Use, the liability of Lesaffre International or any of the subsidiaries of the Lesaffre Group cannot be incurred. On the contrary, the User may be required to compensate Lesaffre International and/or one or more of the Lesaffre Group for any costs, expenses or damages in the event of any or all of them being challenged by another User and/or by a third party for an act attributable to the User.
4.3 The Site is provided as is. Given this fact recognized and accepted by the User, Lesaffre International cannot be held responsible for the temporary or permanent inability of the User to access the Site or all or part of the Site’s functionalities. Lesaffre International’s supply obligation is limited to an obligation of means. Lesaffre International does not guarantee the sustainability or performance of the functionalities accessible on the Site.
4.4 The liability of Lesaffre International and the User cannot be incurred in the event of force majeure as defined by French law and jurisprudence.
4.5 Lesaffre International cannot be held responsible for the consequences:
- of the fault or negligence of the User;
- of the use of the Site by the User not in accordance with these GTU and/or applicable regulations;
- of fraudulent use of the Site by third parties, in violation of the security measures implemented by Lesaffre International.
4.6 Lesaffre International declines any responsibility for indirect damages which, consequently, do not give rise to compensation.
ARTICLE 5 – INTELLECTUAL PROPERTY
5.1 The Site and each of its components, including but not limited to, texts, images, illustrations, photographs, databases, media, software, graphics, logos, icons, sounds, company names, trademarks, product models, designs, animated sequences with or without sound, and other documentation, and more generally, all visual or audio elements (Hereinafter the “Intellectual Property Elements“) are protected by intellectual property rights.
5.2 Lesaffre International holds the intellectual property rights to the Intellectual Property Elements. Some of the Intellectual Property Elements may also be the property of third parties or other subsidiaries of the Lesaffre Group that have granted a license to Lesaffre International to incorporate them directly or indirectly on the Site.
5.3 Consequently, the User refrains from any act of reproduction and representation of the Intellectual Property Elements without authorization from Lesaffre International, such reproduction and/or representation may constitute an act of infringement.

6.2 To know the terms of use of websites published by other subsidiaries of the Lesaffre Group or by websites published by third parties to the Lesaffre Group to which the Site would refer, the User is invited to consult the websites concerned, as well as the general terms of use of said sites.

ARTICLE 8 – MISCELLANEOUS
8.1 In the event that one of the clauses of these GTU is declared null or inapplicable by the effect of a law, regulation or court decision rendered by a competent court with res judicata authority, the other clauses will retain their validity and force.
8.2 The fact that Lesaffre International does not avail itself of a breach by one (or several) User(s) of any of the provisions of these General Terms of Use should not be interpreted as tolerance or waiver on its part to avail itself in the future of such a breach.
ARTICLE 9 – APPLICABLE LAW
9.1 These GTU are governed by French law.
9.2 In the event of a dispute, the Parties will make their best efforts to reach an amicable solution before referral to the Courts. However, in the event of failure of the amicable phase, the most diligent party will refer the matter to the competent court in accordance with applicable legal provisions.
